Founding Cafe Programme Terms
These are the general terms of the Brewly Founding Cafe programme. They describe how the programme works and what each side can expect. Cafes accepted into the programme also receive a written Founding Cafe Agreement, which sets out their individual commercial terms and prevails if it differs from this page. The programme is a customer relationship: it gives no ownership, share or partnership in Brewly. Applying does not create a contract. Acceptance does not take effect until both sides have signed that agreement.
1. The programme
Brewly is a point-of-sale and cafe operations system in private beta. The programme brings a small group of cafes together with the people building it, so the product can be shaped around real service. Brewly is a personal project of Dhaval Pandya, an individual based in Ahmedabad, Gujarat, India ("Brewly").
2. Selection
Every application is considered individually. We decide at our discretion, we are not obliged to give reasons, and a place in the programme is not guaranteed. Places are offered in waves and some applicants will be placed on a waitlist.
3. What we ask of cafes
- A regular conversation with us, at the cadence you indicate in your application.
- To use the product in the running of your cafe as far as is sensible, and to give honest feedback.
- Permission for us to use anonymised and aggregated operating data from your cafe to improve the product. We do not sell identifiable data and we do not name your cafe in that data.
- If you agreed to it, willingness to act as a reference once the product has launched, subject to your approval of the wording.
- To keep unreleased features and pricing confidential until we announce them.
4. What cafes can expect from us
- Direct access to the people building the product, and a real say in what is built and in what order.
- Hands-on help setting up.
- Founding commercial terms, set out in writing in the Founding Cafe Agreement before you commit to anything. Use of Brewly is free during the beta, and we will not charge you anything without your written agreement.
5. The product is a beta
The product will change, and some of it will break. Features may be added, altered or removed. We do not promise uninterrupted availability or any particular level of service during the beta, and you should keep your own record of information you cannot afford to lose. We aim to reply to support messages within one working day. Our working hours are 10am to 8pm India time, Monday to Saturday. This is a target, not a guarantee.
6. Your data
Your cafe's data stays yours. We process it to provide the product to you and, in anonymised and aggregated form, to improve it. How we handle personal information is described in our Privacy Policy. We hold your cafe's customer and staff data only to run Brewly for you. We do not sell it. You can ask us for a copy of it, or ask us to delete it.
7. Ending participation
Either side may end participation by written notice. On ending, we will give you a reasonable opportunity to export your cafe's data. Confidentiality obligations continue after the programme ends.
8. Liability
The beta is provided as it is. To the extent the law allows, neither side is liable to the other for indirect or consequential loss, and Brewly's total liability in connection with the beta is limited to INR 10,000. Nothing here limits liability that cannot be limited by law.
9. Governing law
These terms are governed by the laws of India, and the courts at Ahmedabad have exclusive jurisdiction. We would always rather resolve a concern by talking first.
